Terms and conditions of use

– Introduction

These general conditions of use are applicable between the company SCANDEAT FOOD & BEVERAGE, S.L. B72526163, here in after referred to as SCANDEAT, and any person making an online purchase via the website – gastrocargo.com, here in after referred to as “customer”.

These general conditions of use define the terms of sale between “SCANDEAT” and “customer” from the order till the delivery.

By confirming the order, “the customer” has unconditionally accepted the terms of the said order as well as the terms and the conditions of the sale.

– Date of order

The effective date of the order is defined by the confirmation by the customer followed by the receipt of the full payment made online at scandeat.com. The delivery times quoted on the website are applied on top of the effective date.

– Product Features

Product specifications are given in each product. The photographies are not covered in the contract. SCANDEAT is not liable for any difference between the photography on the website and the received products.

– Price

Product prices are quoted in Euros, including VAT and excluding shipping costs.

The VAT rate applied is the official one applicable on the date of the order.

SCANDEAT reserves the right to change the prices at any time. The products will be charged at the price effective at the time of recording of the order.

– Order confirmation

An email is automatically sent to the customer to confirm the order taking, and provided that the email adress specified in the form of account creation is valid.

– Terms of payment

Payment for items ordered on the site gastrocargo.com is payable in full when ordering.

The means of payment are credit card and bank transfer. Online payment of the order is completely secure.

Any amount not paid will result in payment by the customer of penalties attached to one and half times the legal interest rate. Pursuant to Article L. 441-6 of the Commercial Code, these penalties are payable automatically upon receipt of the notice to the customer that we have debited from it. All amounts to be recovered through litigation flat rate will be increased to 12% of outstanding amounts as damages, in addition to court costs and statutory interest.

All necessary means to ensure the security and confidentiality of transmitted data lines are implemented by SCANDEAT. If paying by credit card, the transaction is via a reputable bank that only has the bank details provided on the site at the time of payment. – Order packing

The order is prepared when SCANDEAT received the full payment and all the shipping information:

Exact billing address, contact name and telephone number – Door Code, floor etc.

Correct delivery address and telephone number of the recipients.

If the package can not be delivered because of an incorrect or incomplete address of delivery, it will be returned to SCANDEAT. The re-delivery will be subject to billing additional shipping costs.

– Delivery and payment method

Your order on the site gastrocargo.com is validated once the company SCANDEAT receives confirmation of your payment.

The amount of shipping is indicated at the end of your order in accordance with our General Terms and Conditions.

Your order will be delivered to the address indicated on your order form.

SCANDEAT is committed to make every effort to ensure the delivery of your order as soon as possible after confirmation and validation of payment.

All orders placed over the weekend (after 12 pm Friday) will be shipped from the following Monday to ensure the transport of your order in the best conditions.

To be sure of your availability, you can tell us the delivery date that suits you best and meet these criteria in the comments of your order.

We draw your attention to the fact that the delivery times above are applicable outside postal delivery problem or force majeure and availability of products. During the holiday season or in case of holiday, this date is indicative only.

In the event of a delay in delivery, SCANDEAT may be exempt from all or part of its liability by proving that the non-performance or improper performance of the contract is attributable either to the consumer or to the post, unforeseeable and irresistible, a third contract, or a case of force majeure.

The products remain the property of SCANDEAT until full payment.

– Availability

All orders will be honored within the limits of available stock. In case of unavailability of the products after your order, we promise to notify you by e-mail or telephone as soon as possible. You can then cancel all or part of your order or exchange of the product concerned.

– Delivery

Your order is protected if necessary by a specific isothermal packaging to preserve all the taste.

– Exceptional events and force majeure

In the event of a strike by the postal services or any other exceptional event slowing or preventing the delivery of packages (snowstorm, attacks, wars …), SCANDEAT will all in their power to inform the client of the state shipment of the parcel, but can not be held responsible for the delays caused.

– Complaint

Any disputes concerning the quality, quantity, type of product should be reported to SN within 48 hours of receipt of the order indicating customer details and invoice number.

Any claim is possible only if the products are kept in their original packaging and in sanitary conditions.

None of the delivered products may be returned without the express agreement of SCANDEAT. In all cases, the cost of returning goods are the responsibility of the “client.”

– Right of withdrawal

The consumer shall have a period of fourteen days to withdraw from a distance contract. This period starts from the date of receipt of product.”The customer” uses this right of withdrawal without giving any reasons or pay any penalty. However, the cost of returning the goods is the responsibility of the “client.”

The goods must be returned in their original packaging.

However, “The Client” will not exercise this right in the case of supply of goods, which due to their nature can not be returned or are liable to deteriorate or expire rapidly (art. L.121- 20-2 of the Consumer Code), that is to say, of fresh products delivered by SN in specific isothermal packaging, allowing cold storage.

– Protection of minors – Ability to contract

In accordance with Article L.3342-1 the Code of Public Health which states that the sale of alcohol to minors under sixteen year is banned, “the customer” is committed, validating his order, to sixteen (16) years of age at the date of the order by checking the appropriate box in the order validation.

Furthermore “the customer,” said by the only validation of his order, not be protected within the meaning of Article 488 of the Civil Code.

– Jurisdiction

All clauses in these terms and conditions relating to a bill of sale or purchase are governed by Spanish law. The consumer can, in addition to a territorially competent court under the Code of Civil Procedure, at his choice appeal the court of the place where he lived at the time of conclusion of the contract or when harmful event occurred.
